You may use the Services only if you agree to form a binding contract with GFX | Productions™ and are not a person barred from receiving services under the laws of the applicable jurisdiction. If you are accepting these Terms and using the Services on behalf of a company, organization, government, or other legal entity, you represent and warrant that you are authorized to do so and have the authority to bind such entity to these Terms, in which case the words 'you' and 'your' as used in these Terms shall refer to such entity.

Using our Services
If you apply for any products or services from this website, the terms and conditions relating to the products or services will apply, rather than these Website Terms and Conditions. The contents of this paragraph do not constitute an offer by us to sell products or services to you. Your request to purchase a product or services represents an offer by you that we may accept or reject. After you ask through this website to purchase the product or services, then assuming such product or services are available and your offer is accepted, you will receive confirmation of your purchase. GFX | Productions™'s privacy policies explain how we treat your personal data and protect your privacy when you use our Services. By using our Services, you agree that GFX | Productions™ can use such data in accordance with our privacy policies, you also consent that we may use the information you provide to conduct appropriate anti-fraud checks. To ensure that your credit, debit or charge card has not been used without your consent, we will validate name, address and other personal information you supply during the order process. In performing these checks, personal data you provide may be disclosed to a registered Credit Reference Agency, which may keep a record.

About our Software/Services
When a Service requires or includes downloadable software, this software may update automatically on your device once a new version or feature is available. Some Services may let you adjust your automatic update settings. GFX | Productions™ gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by GFX | Productions™ as part of the Services. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by GFX | Productions™, in the manner permitted by these terms. You may not copy, modify, distribute, sell, or lease any part of our Services or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission. Open source software is important to us. Some software used in our Services may be offered under an open source license that we will make available to you. There may be provisions in the open source license that expressly override some of these terms.

Mobile and Other Devices
We currently provide our mobile services for free, but please be aware that your carrier's normal rates and fees, will still apply. We may also could send Push notifications that are messages which can be sent directly to a user's mobile device, and which appears on screen, or in the top section of a mobile device. A push notification can only be sent by an app publisher if you have their app installed on your phone, but they also could sent without the app by requiring the Browsers. but still the app/browser must ask the you permission in order to send them. Your/Our Rights and Content on our Services Some of our Services allow you to upload, submit, store, send or receive content. You are responsible for your use of the Services and for any Content you provide, including compliance with applicable laws, rules, and regulations. You should only provide Content that you are comfortable sharing with others. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that might be offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive. All Content is the sole responsibility of the person who originated such Content. We may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. We hope you understand that we may modify or adapt your Content as it is distributed, syndicated, published, or broadcast by us and our partners and/or make changes to your Content in order to adapt the Content to different media.

You represent and warrant that you have, or have obtained, all rights, licenses, consents, permissions, power and/or authority necessary to grant the rights granted herein for any Content that you submit, post or display on or through the Services. Your Account
You may need to create an account to use some of our Services. You are responsible for safeguarding your account, so use a strong password and limit its use to this account. We cannot and will not be liable for any loss or damage arising from your failure to comply with the above. You can control most communications from the Services. We may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your account, and you may not be able to opt-out from receiving them. If you added your phone number to your account and you later change or deactivate that phone number, you must update your account information to help prevent us from communicating with anyone who acquires your old number.

Your License to Use the Services
GFX | Productions™ gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you as part of the Services. This license has the sole purpose of enabling you to use and enjoy the benefit of the Services as provided by GFX | Productions™, in the manner permitted by these Terms. The Services are protected by copyright, trademark, and other laws of both the United States and foreign countries. Nothing in the Terms gives you a right to use the GFX | Productions™ name or any of the GFX | Productions™ trademarks, logos, domain names, and other distinctive brand features. All right, title, and interest in and to the Services (excluding Content provided by users) are and will remain the exclusive property of GFX | Productions™ and its licensors. Any feedback, comments, or suggestions you may provide regarding GFX | Productions™, or the Services is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.

Zero-tolerance
A strict enforcement of regulations and bans against undesirable behaviors. Undesirable behavior is when a user tries to start arguments by upset other users, by posting inflammatory, extraneous, foul language, or off topic messages on all our service,. with the intent of provoking a negative response or disrupting conversation(s). Posting content such as promotional, spam, racism, pornographic, sexual, illegal, or hate content is not allowed on all our services. All content uploaded or provided to the GP | Networking Services must be family friendly. This is including but is not limited to: Avatars, Signatures, Attachments, embeds, posts, as well as messages towards other users. Harassing of Users and/or Staff through private messages and/or public services or any other form of communication is not tolerated, and in any kind unacceptable. Impersonating administrators, moderators, or staff in any way, shape or form via our services is not allowed.

We encourage users to be helpful and remind others of the terms when they see that things aren't going according. However, users should not take over the role of a moderator. These policies are promoted as preventing abuse and/or violating our terms of services.

Modifying and Terminating our Services
We are constantly changing and improving our Services. We may add or remove functionalities or features, and we may suspend or stop a Service altogether. You can stop using our Services at any time, although we'll be sorry to see you go. GFX | Productions™ may also stop providing Services to you, or add or create new limits to our Services at any time. We believe that the experience is one of the most important things to make. If we discontinue a Service, where reasonably possible, we will give you reasonable advance notice and a chance to get information out of that Service.

Changes to the Terms of Services and Privacy Policy

Ending These Terms
You may end your legal agreement with GFX | Productions™ at any time by deactivating your accounts and discontinuing your use of the Services. See http://help.gfx-pro.net for instructions on how to deactivate your account and the Privacy Policy for more information on what happens to your information. We may suspend or terminate your account or cease providing you with all or part of the Services at any time for any or no reason, including, but not limited to, if we reasonably believe:
(i) you have violated these Terms of Services or Legals,
(ii) you create risk or possible legal exposure for us;
(iii) your account should be removed due to unlawful conduct,
(iv) your account should be removed due to prolonged inactivity; or
v) our provision of the Services to you is no longer commercially viable.

We will make reasonable efforts to notify you by the email address associated with your account or the next time you attempt to access your account, depending on the circumstances. In all such cases, the Terms shall terminate, including, without limitation, your license to use the Services, except that the following sections shall continue to apply: II, III, V, and VI. If you believe your account was terminated in error you can file an appeal following the steps found in our help center (http://help.gfx-pro.net).

Certain links may lead you to websites that are not under our control. When you activate any of these links, you will leave this website and we have no control over, and will accept no responsibility or liability for, the material on any other website.

Custom Searching and Engine Optimization
Custom Search enables us to create a search engine for our website, blog, or a collection of services. We can configure our CSE to search both web pages and images. We can fine-tune the ranking, customize the look and feel of the search results, and invite our members or trusted users to help us build our custom search engine. We could display advertisements and/or promotions. We can use your expertise about a subject to tell Custom Search which websites to search, prioritize, or ignore. Because who knows it better than the users itself, can tailor the search engine to their own interests.

Sales and subscriptions
All sales are final. Under no circumstance any refunds will be given.

Unless otherwise specified, the products and services described in this website are available to residents throughout the world. Users under 18
Some GFX | Productions™ Products - "our product's" may have age restrictions which prevent users under 13 creating an account. If a product is not subject to age restrictions, a user under 13 may create an account. However, they must get consent from their parents/guardians to use the product's in accordance with our terms and conditions and privacy policy. We may Stop any account if we are not satisfied that such consent has been given or that such consent does not comply with local laws regarding users who are under 13 years of age. We do not knowingly collect or store any personally identifiable information from children under 13. If we find out that any personally identifiable information we have collected is from someone under 13, we will automatically delete it, and we may Stop the source account for that information. We recommend that parents/guardians should play together with their children who are under the age of 13. If you are under 18, by using our website you are representing (i.e. making a promise) that you have consent from your parents/guardian to use 'our products' in accordance with our terms and conditions and privacy policy. We may Stop any account if we are not satisfied that such consent has been given.
